​Cancellation and Suspension of vehicle/driving license And suspension of plates

Article (362)

Without prejudice to this regulation, and provisions of Traffic Act, vehicle license will be cancelled in the following cases:

  • The operated vehicle is seized without plates, or the vehicle's plates are switched with another one whether with identical or different data, the vehicle's plates are different from the license issued at traffic unit, or are being spoiled. The license will be cancelled from the date of seizure, and shall be restored no earlier than 3 months, in accordance with Traffic Act article14.
  • The operated vehicle is seized prior notifying of the specifications changed, and before the completion of its technical inspection. The license is cancelled from the date of seizure, upon Traffic Act article 17.
  • The lack of notifying of the vehicle's ownership transfer, and failure to complete the change of ownership procedures within 30 days on the first day after the date in which the ownership transfer document come to force, according to Traffic Act article 10. The license is cancelled on the first day after the period expiry date, upon Traffic Act article 19.
  • The lack of notifying of Change owner of a vehicle on the exact date according to article 20, or the lack of notifying of Transfer of ownership upon death of the owner on the exact date according to article 21. The license is cancelled from the first day of the expiry date.
  • The Violation of the commercial/temporary license conditions, or the use of commercial/temporary license for purposes other than those specified in Traffic act articles (25-26), and the regulation articles (231-233). The vehicle is considered in operation without license.
  • The operated taxicab is equipped without taximeter accepted by the competent traffic unit according to Traffic Act article (28), in one of the governances that are applying taximeters system.
  • The evasion of taxes and charges, imposed on slow transit vehicle that have at least three years license, for 30 days after the expiration of taxes and charges payment period that is determined during license validity period.
  • The provisions of articles 1, 2, 3 &4 are applicable to slow transit vehicle.
  • As for conditions of this regulation in article (366), the driver license is cancelled, and slow transit vehicle license of bicycles/carts are cancelled for the exact determined period.
  • The recurrence of traffic offenses committed by (fare paid per person) taxicab drivers and the taxicab is operated without a license issued from competent traffic unit ,within a zone outside the governorate where it is licensed to operate, during six months since the first offense commitment.
  • The licensee's lack of notifying of changing his place of residence stated on the license within 30 days from the first day of changing place of residence, beside his lack of fulfillment of transfer registry application if the new place of residence is located outside the previous governance in the aforementioned period. The licensee is granted temporary vehicle license/ plates after paying taxes and charges of transfer registry application to the competent traffic unit where place of residence belongs to.
  • The vehicle is seized while operating for purposes other than stated on the license, and the suspended license shall not be restored earlier than 30 days. If the offence is repeated within 6 months since the date of first violation, the vehicle license suspension shall not exceed 3months. If the offence is repeated within one year, the vehicle license suspension shall not exceed 6 months. Generally, Vehicle license suspension is applied on condition that the vehicle's owner has acknowledged and approved to operate his vehicle on purposes other than stated on vehicle license.
  • The driver is continuously stopped while behaving or merely allows the behavior in violation of public morals during one year from the date of the previous immoral behavior commitment, the suspended vehicle license shall not be restored before six months. In case the vehicle owner proves acting in good faith, the license suspension is inapplicable, the vehicle owner can restore suspended license unless his knowledge of the incident is proved.

Article (363)

Without prejudice to this regulation, and other provisions of Traffic Act, the vehicle license shall be suspended in the following cases:

  • The lack of license renewal procedures fulfillment within 30 days following the expiry date, despite paying renewal taxes and charges before the aforementioned period. The vehicle license remains suspended till the renewal procedures are completed upon Traffic Act article (24).
  • The recurrent seizure of a taxicab with faulty taximeter within one year since its previous seizure. The vehicle license is suspended for 30 days and the faulty taximeter should be fixed upon Traffic Act articles (3/28).
  • The vehicle is incompatible to safety and durability conditions, vehicle license is suspended till conditions were met upon Traffic Act article (33).
  • The driver is arrested while behaving or merely allowing the behavior in violation of public morals, the vehicle license is suspended for 90 days from the date of arrest upon Traffic Act article (72). The vehicle owner can restore the suspended license unless his knowledge of the incident is proved.
  • The provisions of articles 1, 2, 4, 5 &7 are applicable to slow transit vehicle.
  • The fare paid per person taxicab is operated within a zone outside the governorate where it is licensed to operate, without the permission of the competent traffic unit, the taxicab license is suspended for 30 days.
  • The seized vehicle is driven by unlicensed person, or the driving license is: cancelled, suspended, or incompatible. The vehicle license is suspended no longer than 90 days. The vehicle's owner can restore the suspended license unless his knowledge of the incident is proved.

Article (364):

Without prejudice to this regulation, and provisions of Traffic Act, vehicle plates shall be suspended in cases stipulated in Traffic Act article (14).

Article (365):

The license of a taxicab may be suspended if it is seized with faulty taximeter. The suspension period shall last for not less than 15 days, and shall not exceed 30 days; (15-30) days. Whether the license is suspended or not, the taxicab shall not be operated unless the faulty taximeter is fixed or replaced by another upon Traffic Act article (28).

Article (366):

The Driving license is cancelled on the following conditions:

  • The vehicle is seized without plates, or its plates were: different from those issued at the traffic unit, issued from the traffic unit for a different vehicle, or switched with another one whether with identical or different data in accordance with Traffic Act article14. The license will be cancelled since the date of the vehicle's seizure and shall be restored no earlier than 3 months from that date.
  • The vehicle with license suspended is seized in operation in public road according to Traffic Act article (15). The license cancellation is activated since the date of the vehicle's seizure, and the license shall not be restored earlier than 90 days from the date of the license cancellation.
  • The lack of notifying of changing place of residence stated on the license to another governance in 30 days from the first day of this changing, and not presenting the filled out transfer registry application to the new traffic unit at the new governance upon Traffic Act article (38).
  • The driver is stopped while operating a vehicle under the influence of drugs or alcohol within one year from the last date of his arrest committing the same violation. Moreover, in cases when the driver refuses to undergo drug or sobriety test, flees or eludes police once suspected, and the date of his testing results upon violation does not exceed one year from the last same violation. The driving license is cancelled for 6 months, once the accident repeated, the license is revoked, and shall not be restored before at least one year from the date of revocation.
  • The provisions of this article is applicable to slow transit vehicle's licenses, whenever similar violations occur by bicycles and carts the license of slow transit vehicle is cancelled.
  • The vehicle is operated for a purpose other than stated on the license, and the driving license shall not be restored before 30 days. In case the violation is repeated within 6 months from the date of committing the same violation, the driving license shall be cancelled for maximum period 3 months. If the violation is repeated once more within one year from the date of the same violation committed, the driving license shall be cancelled for maximum period six months.
  • The vehicle's driver is repeatedly arrested for behaving or merely allowing the behavior in violation of public morals within one year from committing the last same violation, the driving license shall not be restored before six months.
  • The vehicle's driver commits one of violations stipulated in Traffic Act articles (28, 70, 72 bis) within one year from the date of the previous violation, the driving license shall not be restored before one year from the date of cancellation.

Article (367):

The driving license shall be suspended in the following cases:

  • The driver is stopped for the first time while operating a vehicle under the influence of drugs or alcohol, and if the driver refuses to undergo drug or sobriety test, flees or eludes police once suspected for being drunk or drugged driving, the driving license is suspended for 90 days upon Traffic Act article(66).
  • The driver is seized while behaving or merely allowing the behavior in violation of public morals, the driving license is suspended for a maximum period 90 days from the date of seizure.
  • The provisions of this articles 1&2 are applicable on licenses of slow transit vehicles. And in case the violation is committed by a bicycle or cart rider, the license of slow transit vehicle shall be suspended for the same period determined for vehicle suspension.
  • The taxicab is seized repeatedly with faulty taximeter within six months, the license is administratively suspended for 30 days.
  • Any driver of a taxicab ( licensed with taximeter or without) who unjustifiably refuses to drive the person, refuses to operate the taximeter, asks for extra fare rather than determined, drives more people than capacity limit (extra loads), stops to pick up people at non-designated taxicab stands without taximeter, the driving license shall be suspended for 30 days. In case the driver commits any of those violations again in six months from the previous date of suspension, the driving license shall be suspended for 90 days.
  • The driver causes any road pollution by throwing items or wastes from the vehicle, or in cases where the vehicle makes noisy sounds, or spreads heavy smokes or nasty odors, spills inflammable substances or any other that threatens public health, or impedes the movement of traffic, or drops what affects road safety or harms users, the driving license shall be suspended for at least 30 days and no longer than 60 days; (30-60) days. If the driver commits the same violation within 3 months from the date of the previous violation, the driving license shall be suspended for 90 days. If the driver repeat the committed violation again within six months from the date of the second violation, the driving license shall be suspended for one year.

Article (368):

First: the driving license shall be suspended for at least 30 days, and no longer than 60 days;(30-60) days, or for the rest of the license validity period -whichever is the lesser- in case the driver commits one of the following violations:

  • Allows persons to sit on the vehicle surface while being operated;
  • Drives the vehicle at night with headlights, taillights, or light reflectors turned off, even if they were not in use because they were not attached in the vehicle, or attached but need to be fixed;
  • Uses high beam headlights or bright lights for purposes other than those specified;
  • Stops the vehicle at night in dark places at public road with the dim headlights, taillights, or light reflectors turned off;
  • Uses the vehicle in purposes other than those specified in the vehicle license;
  • leaves the vehicle behind him in a public road where others' lives, or properties are threatened, and impedes the movement of the traffic;
  • Fails to abide by traffic lights, or complies with traffic cop's traffic regulating instructions;
  • Fails to abide by the right side on a two- way road;
  • Fails to notify competent authorities of accidents occurred to him that left casualties, and fails to help them to reach the nearest hospital whenever needed;
  • Operates the vehicle without license, or its license is expired, or suspended, or its plates are suspended;
  • Exceeds speed limit or threatens the lives and properties of others;
  • Operates the vehicle without the two brakes, or any of the two brakes needs to be repaired;
  • Operates the vehicle with incompatible license;
  • Impedes or disrupts deliberately the movement of traffic;
  • Uses the vehicle's horn improperly;
  • Commits assault or battery towards a Police Officer on duty;
  • Uses the vehicle in private convoys /gatherings without the permission of competent authorities;
  • Fails to meet compatible conditions set for transport vehicles about weight, length, width, or height;
  • Drives in opposite direction. Without prejudice to provisions of Traffic Act article 73, the driving license shall be suspended by traffic officer.

Second: the driving license may be administratively suspended if the taxicab is seized with faulty taximeter for a period not less than 15 days, no longer than 3o days.

Article (369):

In cases where the vehicle license is suspended due to incompatible technical conditions, or mismatched safety and durability conditions, the owner's vehicle shall be handed a temporary permit for maximum seven days to meet the required conditions, and avoid incompatibility. The owner may have another vehicle license valid for 24 hrs.to be re-examined technically at the traffic unit.

Article (370):

Under all conditions where Traffic Act constitutes license suspension, revocation, or cancellation, the chief of traffic unit or his substitute; senior police officers shall resolve the confiscated licenses once presented. The concerned person may file a petition to the competent court since the date of confiscation for seven days from the date of notification. The court shall expeditiously consider the petition after hearing the petition applicant and inspecting documents.

Article (371):

Under all conditions where Traffic Act constitutes the license suspension, revocation, or cancellation, the competent court shall state that the license is suspended, revoked, or cancelled and issues the traffic violation penalties.

Article (372):

The provisions of the Traffic Act article (33) states that ,following the drawing up of the necessary official report, the seized vehicle should be sent to the nearest traffic unit or police station .The official report states the type of violation that caused such suspension, and all procedures taken against the vehicle's owner or driver. Either The police unit that received the seized vehicle, or the police unit where the police station that seize the vehicle belongs to shall examine the technical condition of the vehicle. If the examination proves incompatible safety and durability conditions, the driver/owner shall be handed a temporary permit in a certain form, according to the provisions of this regulation article (369). Other than that condition, the police agent who issues the official report shall send the license to the competent traffic unit, hand over the driver vehicle seizure notice and a temporary permit for a period no longer than 7 days to meet the required technical condition. The delivery of the temporary permit to the competent traffic unit is recommended to re-examine the vehicle.

Article (373):

The vehicle owner is obliged to hand over the plates in the following conditions:

  • The vehicle license is suspended.
  • The vehicle license is expired (in the following day at most).
  • The vehicle is abandoned.
  • The vehicle license is cancelled upon Traffic Act articles (15, 17, and 19).
  • The vehicle plates are suspended according to Traffic Act article (14).

In case the vehicle's owner refuses to hand over the plates, the competent traffic unit shall seize the plates instead and it may seize the vehicle if it is still operated.
The insurance value shall belong to the State, if the owner refuses to hand over the plates at the license expiry date or license suspension/cancellation, or at the suspension/confiscation of the plates.
